The Non-Declaration of War Continues to Cause Problems for US - Hamdan Case May End in Mistrial - Update

As Conspirators know, the only constitutional action for Congress to take if its members want the President to lead the troops as Commander-in-Chief, is to declare War. Without a declared War, the US government has been scrambling to find ways to hold and try members of al Queda and other so-called "enemy combatants". Now, the situation has reached a boiling point in the bogus "military tribunals" set up by Congress in 2006. As Gardner Goldsmith has mentioned on the air and in "Live Free or Die", without an official declaration of war, one cannot expect the gubment to be able to try these guys as "War Criminals". It's pretty much inevitable that the Bush Admin would run into this problem, and it's exactly what is happening now, in the trial of Saleem Hamdan. Check out this article that explains the latest:
