Gard posted this on his Twitter, and it I'm pretty sure this will be my last "WTF?" moment of the year, but no doubt the biggest.

The Constitution, the document that government officials are sworn to uphold and protect, has NO binding power if you listen to this guyl. I mean, I know they *act* like it has no power. But to hear someone come out and say it just blew me away.

Or maybe I should respect that this dude is the only one that has the cajones to come out and admit it. I mean, they all act like it doesn't.

It's going to be entertaining to see just exactly what these guys in congress come up with as citations for the constitutional authority for bills if they actually do this enumerated powers citation deal.  I wonder if they will simply cite court cases which declared what they are doing or something similar as "constitutional".  That would be the simplest thing to do.  We will probably hear commerce clause a lot.  One reason I think they actually want this is that it will imply this sort of official pronouncement of constitutionality right there on the floor of congress, thereby psuedo-negating subsequent claims of unconstitutionality.  "What do you mean it's unconstitutional, we declared it constitutional when we read the bill, see it's right there in the congressional record"

I'd like the congress to begin by explaining how the constitution itself doesn't violate the principles laid out in the declaration.
