Of course, to have "standing", one must show that harm has been done to him, but in order to show this, the ACLU must show that its members, or those joining the suit, have been wiretapped without warrants. The only trouble IS, that the federal government holds all those records, and WILL NOT release them. Can you say, "catch 22"?
